U.S. Attorney General and ATF Conspire to Deprive Private Citizens of Gun Rights (Legal Objection to ATF 2022R-17)

There has been a lot of discussion recently regarding the Bureau of Alcohol, Tobacco, Firearms and Explosives' (ATF) plans to modify the definition of "engaged in the business" as a firearms dealer. If these plans are successful, it would impact the gun rights of millions of Americans by requiring private citizens to become Federal Firearms Licensees.

On August 30, 2023, Merrick Garland, the Liberal Attorney General (AG), approved a proposed ATF rule that mandates gun owners to obtain a license from his agency in order to exercise their Second Amendment rights. Specifically, the AG and ATF want to implement the Bipartisan Safer Communities Act (BSCA) enacted on June 25, 2022. The BSCA aims to regulate the sale of firearms by private citizens who were previously exempt from such regulations.

By broadening the definition of "engaged in the business" as a firearms dealer through the BSCA, individuals who are not specifically in the business of selling guns would be required to obtain a dealer license in order to sell their own personal firearms. The proposed ATF rule (ATF 2022R-17) outlines the intricacies of how the Attorney General and ATF intend to implement the new regulation. Additionally, it delves deeply into the alleged laws that grant them the authority to do so.

We reviewed the lengthy document and discovered clear deception present throughout. Not only do many of the legal sources listed fail to support the regulation of private citizens, but they explicitly reject it. However, the AG and the ATF are aware that most people will not read the entire document—and even if they do, very few will fully comprehend it. Unfortunately, this includes expensive lawyers and organizations advocating for gun rights, who have been unsuccessfully fighting a difficult battle for many years.

We the Politicists stepped to the plate and shredded the proposed rule in great detail via our Public Comment on ATF 2022R-17. We went through and exposed the deception point by point. What began as a legal objection to ATF 2022R-17 has turned into a full-on campaign to expose the AG and ATF conspiracy against the American People-- and we included the legal grounds for doing so. This is something that the best and brightest attorneys could not do in years--yet we were able to accomplish this in days. (It took us less than 72 hours).
